Are You Kidding Me?

I just found this story on CNN:

HARRISBURG, Pennsylvania (AP) — A state appeals court ruled that a verbal agreement between a woman and her sperm donor was invalid, and ordered the man to pay child support for the woman’s twins.

The three-judge panel ruled Thursday that the deal between Joel McKiernan and Ivonne Ferguson — in which McKiernan donated his sperm and would not be obligated to pay any support — was unenforceable because of “legal, equitable and moral principles.”

Despite an agreement that appeared to be a binding contract, the father is obligated to provide financial support, the court decided.

“It is the interest of the children we hold most dear,”‘ wrote Senior Judge Patrick Tamalia.

I’m sorry, but this is bull. This guy helps a woman out by giving her a chance to have children, signs a contrac and everything… This is a woman who intentionally went about having children while apparently single, or unable to care for the children on her own.

This just goes to show you how the courts hate fathers and blindly side with mothers.

    This court’s ruling has failed justice miserably. The plaintiff (woman) had the choice to become pregnant or not. Why should the donor be forcefully penalized? Are all sperm donors now going to be liable for child support to whomever receives his seed? Will all men now be reluctant to become donors because of the possible legal implications?

    This lunatic justice is clearly punishing the innocent and rewarding the guilty and contributing to further the welfare-state and big, all pervasive government mentality.

    Do left-leaning, activist, lunatic judges really wanna foul things up as badly as they are doing? Perhaps they wanna screw up our society so that the Communist party or Socialist party or Green party or Democratic party can then run roughshod over all of our state and national laws. As I see it, it seems to be all parties against the Republican party. It’s starting to become similar to everyone against the Jews?

    Perhaps that’s it.

    This sounds like a news of the weird kind of story, its ridiculous that this could happen but without statistics or numerous instances of this occuring I don’t think your conclusion has any weight.

    Part of me wants to agree with the main feeling of Matt’s response and others. I feel that if you have a contract it should be honored. However, part of me feels bad for the child in all of this and if the child is in financial trouble, who else but the natural father of the child should assist? I do not think there is a difference between sperm delivered via sex or a syringe. The end result is a child of 2 people. I am on the fence …sigh….

    Any fool that wants to donate his sperm and put himself at risk for something like this deserves just that.

    I understand exactly your feelings, Fred. Such unusual circumstances, and a legal contract between them yet obvious need for children.

    Something’s just out of wack. I’m not sure I like the idea of a sperm bank in the first place - doesn’t it seem to be a repository for recessive genes? Maybe I’ve said too much..

    This is the first step in what could easily become slews of lawsuits against sperm donors now. What’s next? Go sue a person for donating a kidney that failed.

    Fred you dolt, the child wasn’t an accident it was planned. it was planned, without the need for the “father’s” money. it was planned to be supported by the mother alone. she simply goldbricked months later.

    NOW HEAR THIS- I know the person involved here and he did not have a written contract for this sperm “donation”. In fact he was married and having an affair witht his Ivonne person. She got pregnant but they didnt want to get married. She split with the kids and told him dont worry about it, she would take care of the twins. Now ten years later she wants to get paid. he is liable as he should be for sleeping with a black woman in the first place.
